Handling Death Admin as a Muslim in the UK

The first 24–48 hours: a prompt burial and the paperwork

Islamic tradition encourages burial as soon as practicable, often within a day. In the UK a burial can't legally take place until the death has been certified and registered, so the real task is getting that paperwork moving quickly:

• Ask the hospital or GP for the medical certificate of cause of death (MCCD) as a priority, and explain that a prompt burial is needed for religious reasons. Since 2024 a medical examiner also reviews the death before it can be registered — staff are used to expediting this for faith communities.
• Register the death (within 5 days in England & Wales, but you can go sooner). The registrar issues the certificate that lets the burial proceed — ask your local register office about same-day or out-of-hours appointments.
• If the death was sudden, unexpected or unexplained it may be referred to the coroner, which can delay the burial. Many coroners' offices will prioritise cases where faith requires a rapid burial — it's worth asking.

The estate: Islamic inheritance and UK law

Once the funeral is behind you, attention turns to the estate — the money, property and possessions. This is where Islamic and UK law can pull in different directions, so it's worth understanding clearly:

• With a will: UK law lets you distribute your estate as you wish, so an Islamic will (wasiyyah) drafted to be valid under UK law can set out the fixed faraid shares for your family.
• Without a will: the estate passes under UK intestacy rules, which do not follow faraid — a surviving spouse and children inherit set statutory amounts that may differ from the Islamic shares. This is the single biggest reason scholars encourage Muslims in the UK to make a will.
• Either way, you'll usually need probate (or letters of administration) before banks and the Land Registry will release or transfer the deceased's assets.
